Bewuk Terms of Use

Bewuk provides a personalized subscription service that allows our members to access the management of our audiobook reading and listening platform (the "Bewuk Content") streamed over the internet to certain TVs and other internet-connected devices ("Bewuk-Ready Devices").
These Terms of Use govern your use of our service. As used in these Terms of Use, the phrases "the Bewuk Service," "our Service," or "the Service" refer to the personalized service provided by Bewuk for reading and listening to Bewuk content, including all features and functionality, recommendations and reviews, the website and user interfaces, and software associated with our Service.

1. Membership
1.1. Your Bewuk membership will continue until you cancel it. To use the Bewuk service, you must have internet access and a Bewuk-ready device, and provide one or more Payment Methods. "Payment Method" means a current, valid, and accepted payment method that can be updated and supports payments through third parties. Unless you cancel your membership prior to the billing date, you authorize us to charge your Payment Method for the next billing cycle's membership (see "Cancellation" below).
1.2. We may offer a variety of membership plans, including special promotions plans or memberships offered through third parties along with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. Certain memberships have different conditions and limitations that are clarified in the subscription agreement or other communications. You can find specific information about your Bewuk membership by visiting our website and clicking on the "Memberships" link available in our FAQ section.

2. Offers      and Promotions
2.1. Your Bewuk membership can start with a free trial. The length of your membership's free trial period will be specified at the time of subscription, and is intended to allow new members and certain former members to try out the service.
2.2. Bewuk determines eligibility for the free trial in its sole discretion and we may limit eligibility or duration to prevent abuse of the free trial. We reserve the right to revoke the free trial and suspend your account if we determine that you are not eligible. Members in households with an existing or recent Bewuk membership are not eligible. We may use information such as device ID, payment method, or account email address used with an existing or recent Bewuk membership to determine eligibility. Restrictions may apply to combinations with other offers.
2.3. We will charge the membership fee for the next billing cycle to your Payment Method at the end of the free trial period, unless you cancel before the end of the free trial period. To view the membership price and the end date of the free trial period, visit our website and click on the "Billing Information" link on the "Account" page.

3. Billing      and cancellation
3.1. Billing Cycle. Membership fees for the Bewuk Service and any other charges you incur in connection with your use of the Bewuk Service, such as taxes and potential transaction fees, will be charged to your Payment Method on the specific billing date indicated on the "Account" page. The length of your billing cycle will depend on the type of subscription you select when you sign up for the service. In certain cases, your payment date may change, such as if your Payment Method was not successfully established or if your paid membership began on a day that is not included in a given month. Visit our website and click on the "Billing Information" link on the "Account" page to view your next payment date. We may authorize your Payment Method prior to payment related to the membership or service through various methods, including authorizing your Payment Method to last approximately one month of service from your registration. In some cases, your available credit balance or limit will be reduced as a result of authorization.
3.2. Payment methods. To use the Bewuk service you must provide one or more Payment Methods. You authorize us to charge any Payment Method associated with your account in the event of a rejection or unavailability of your primary Payment Method. Any outstanding charges will be yours. If payment cannot be made satisfactorily, due to due date, lack of funds, or other reason, and if you do not cancel your account, we may suspend your access to the service until we obtain a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees related to the processing of your Payment Method. Local taxes vary depending on the Payment Method used. Please check with your Payment Method's service provider for information.
3.3. Updating Your Payment Methods. You can update your Payment Method under "Account". You can also update your Payment Method with the information provided by the relevant payment service provider. Following any updates, you authorize us to charge the applicable Payment Methods.
3.4. Cancellation. You can cancel your Bewuk membership at any time, however this may result in an automatic cancellation of your account. To the extent permitted by applicable law, payments are non-refundable and no refunds or credits will be given for partially used membership periods or for unseen Bewuk content. To cancel, visit the "Account" page and follow the instructions. If you cancel your membership, your account will be automatically closed at that time or at the end of your current billing period. If you subscribed to Bewuk through your account with a third party as a Payment Method and wish to cancel your Bewuk membership at any time, you may need to do so through such third party, either by visiting your account with the applicable third party to turn off your automatic renewal or by unsubscribing to the Bewuk service through that third party. You can also find billing information for your Bewuk membership by visiting your account with the relevant third party.
3.5. Changes to Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time. However, any changes to prices or your subscription plans will take effect no earlier than 30 days after notification.

4. Bewuk Service
4.1. You must be 18 years of age, or the age of majority in your province, territory or country, to be a member of the Bewuk service. Minors may use the service with adult supervision.
4.2. The Bewuk Service and all content viewed on it are for personal, non-commercial use only, and should not be shared with persons who are not members of your household. During Bewuk membership, we grant you a limited, non-exclusive, non-transferable right to access the Bewuk service for the purpose of viewing Bewuk content through our streaming service. Beyond this, no other right, title, or interest will be transferred to you. You agree that you will not use the service for public performances.
4.3. You may view Bewuk content primarily in the country where you established your account and only in the geographical locations where we offer our service and where that content is licensed. The content that may be available to watch may vary by geographic location and changes periodically. The number of devices you can watch on simultaneously depends on the chosen subscription plan and is specified on the "Account" page.
4.4. Bewuk updates the service continuously, including its content catalog. In addition, we regularly test various aspects of our service, including our website, user interfaces, promotional features, and Bewuk's content availability.
4.5. Some of the Bewuk content is available for temporary download and offline viewing on certain compatible devices ("Offline Titles"). Restrictions apply, including restrictions on the number of offline Titles per account, the maximum number of devices that can contain offline Titles, the period in which you must begin viewing Titles offline, and how long Titles will remain accessible. Some offline Titles may not be playable in certain countries, and if you connect in a country where that Title is not streamable offline, that Title may not be playable while you are in that country.
4.6. You agree to use the Bewuk Service, including all features and functionalities associated with it, in compliance with all applicable laws, rules and regulations, or any other restrictions on the use of the Service or its contents. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works based on the Service, or offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained in or obtained from the Bewuk Service. You also agree not to: bypass, remove, alter, disable, interfere with, or circumvent the content protections of the Bewuk service; not to use any robot, spider, scraper, or other automated way to access the Bewuk Service; or decompile, reverse engineer, disassemble the software or other product or process accessed through the Bewuk service; otherwise introduce code or product or manipulate the content of the Bewuk service; or use any method of analysis, extraction or obtaining of data. You further agree not to upload, post, email, or otherwise transmit any material designed to interrupt, destroy, or limit the functionality of the computer software, hardware, or telecommunications equipment associated with the Bewuk Service, including material that contains software viruses or any other code, files, or programs. We may terminate or restrict your use of our service if you violate any of the Terms of Use or use the service illegally or fraudulently.
4.7. The quality of the image, text and audio of Bewuk content may vary from device to device and may be affected by various factors, such as location, available bandwidth or internet connection speed. The availability of High Definition (HD), Ultra High Definition (Ultra HD), and High Dynamic Range (HDR) content depends on your internet service and the device in use. Not all content is available in all formats, such as HD, Ultra HD, or HDR, nor do all subscription plans allow you to receive content in all formats. The default playback settings on cellular networks exclude HD, Ultra HD, and HDR content. The minimum connection speed for SD quality is 0.5 Mb/s. However, we recommend a faster connection to improve screen quality. A download speed of at least 15 Mbps per stream is recommended for HD content (defined as 720p resolution or higher). A download speed of at least 25 Mbps per stream is recommended for receiving Ultra HD content (defined as 1080p resolution or higher) and HDR content. All internet access charges will be at your own expense. Ask your internet provider for information about possible data consumption charges for internet use. The time it takes to start watching Bewuk content will vary depending on a variety of factors, including where you are, the bandwidth available at the time, the content you've selected, and the settings of your Bewuk-ready device.
4.8. The Bewuk software is developed by Bewuk or at the request of Bewuk, and was designed to enable content to be viewed through Bewuk-ready devices. This software may vary by device and medium, and functionality and features may also vary from device to device. You acknowledge that use of the Service may require third-party software that is subject to third-party licenses. You agree that you may automatically receive updated versions of the related software from Bewuk or third parties.

5. Passwords and account access. The member who created the Bewuk account and is billed for charges through their Payment Method (the "Account Holder") has access to and control over the Bewuk account and the Bewuk-ready devices used to access our service and is responsible for any activity that occurs under the Bewuk account. To maintain control over the account and prevent anyone from accessing the account (which would include information about the account's viewing history), the Account Holder should maintain control over the Bewuk-ready devices used to access the service and not disclose the password or Payment Method information associated with the account to anyone. It is your responsibility to update and maintain the accuracy of the personal information you provide to us regarding your account. We may decide to terminate your account or suspend it to protect you, Bewuk, or our partners from identity theft or other fraudulent activity.

6. Disclaimer of Warranties and Limitations on Liability. Bewuk's service is provided "as is," without warranty or condition. In particular, our service is not declared uninterrupted or error-free. You waive all special, indirect, and consequential damages against us. These terms shall not limit the non-waivable warranties and consumer protection rights to which you are entitled under the laws of your country of residence.

7. Declaration of faith. By creating an account on Bewuk.com, I freely and voluntarily acknowledge and accept Jesus Christ as my Savior and Messiah, in accordance with Christian teaching and Jewish standards. I understand that this platform is based on Judeo-Christian principles and that its purpose is to foster values aligned with the Gospel and Torah.

8. Class Action Waiver. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND BEWUK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER PARTY ONLY ON YOUR OWN BEHALF, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS OR REPRESENTATIVE ACTION. In addition, if applicable law permits, unless both you and Bewuk agree otherwise, the court may not join more than one person's cases with your cause or otherwise may not hear any representative or class action.

9. Miscellaneous
9.1. Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of the country of residence of the membership.
9.2. Unsolicited Material. Bewuk does not accept unsolicited materials or ideas, the only means by which content can be uploaded within Bewuk is through Self – Publishing Bewuk. Beuwk is not responsible for the similarity between the contents or programming of any media with the materials or ideas transmitted to Bewuk.
9.3. Customer Service. If you need to learn more about our service and its features, or if you need assistance with your account, please visit the Bewuk Help Center on our website. In some cases, Customer Service will be better able to assist you by using a remote access assistance tool that fully accesses your computer. If you do not want us to have this access, you should not authorize support through the remote access tool and we will assist you in another way. In the event that there is a conflict between these Terms of Use and the information provided by Customer Service or other sections of our website, these Terms of Use shall govern.
9.4. Continued Validity. If any provision of these Terms of Use is held to be void, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
9.5. Changes to the Terms of Use and Assignment. Bewuk may change these Terms of Use from time to time and may or may not make them external to the User. We may assign or transfer our agreement with you, including our associated rights and obligations, at any time and you agree to cooperate with us in connection with any such assignment or transfer.
9.6. Electronic communications. You provide Bewuk with the ability to send such information regarding your account as we deem appropriate including, but not limited to, but not limited to (payment authorizations, invoices, password or Payment Method changes, confirmation messages, notices) electronically only, for example, by email to the email address provided during registration.
